These Terms of Service (“Terms”) are a binding agreement between you and Metaieb LLC, a Delaware limited liability company with offices at 8840 Washington Blvd, Suites 301 and 305, Culver City, CA 90232 (“Metaieb”, “we”, “us”), the operator of FirstPrint (firstprint.app, the “Service”). By creating an account or purchasing a portrait, you agree to these Terms.
For entertainment only
FirstPrint portraits are provided strictly for entertainment, novelty, and souvenir purposes. They are not predictions of any kind. They are not medical, psychological, psychiatric, behavioral, developmental, educational, legal, or financial advice. They are not factual claims about your child. No portrait should be relied upon for any decision making whatsoever. If you have concerns about your child's health, development, or wellbeing, please consult a qualified professional.
Eligibility
You must be at least 18 years old and the parent or legal guardian of the child whose photograph and birth details you submit. By using the Service, you represent that you meet these requirements and that you have the right to upload the photo and details you provide.
Your content
You retain ownership of the photos and information you upload. By submitting them to FirstPrint you grant us a limited, non exclusive license to process them solely to write, deliver, and store your portrait on your behalf. We do not sell your content, do not share it publicly, and do not use it to train any model. See our Privacy Policy for details.
Pricing and payment
Each portrait is a one-time purchase priced as displayed at checkout (currently $12.79 USD). Payments are processed by Stripe. Applicable taxes may apply depending on your jurisdiction.
Refunds and satisfaction
We want you to love your portrait. If it doesn't feel right, the writing failed, or your portrait was never delivered, email support@firstprint.app within 7 days of purchase and we will either:
- Rewriteyour portrait once, free of charge, at our team's discretion; or
- Refund your purchase in full, your choice.
Refunds appear on your statement within 5 to 10 business days. We review each request individually and reserve the right to decline refunds in cases of demonstrable abuse (e.g. repeated free-rewrite requests on the same purchase, attempts to claim a refund after sharing the portrait widely).
Acceptable use
You agree not to (a) upload content that is not a photo of your own child's foot or that you do not have the right to upload; (b) use the Service to harass, defame, or harm any person; (c) attempt to reverse engineer, scrape, or interfere with the Service; (d) use the Service in any unlawful manner. We may suspend or terminate accounts that violate these Terms.
Service availability
We aim to keep FirstPrint available, but we do not guarantee uninterrupted access. The Service is provided “as is” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the maximum extent permitted by applicable law, Metaieb LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenue, arising out of or in connection with your use of the Service. Our total liability for any claim arising out of or related to these Terms will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $25.
Indemnity
You agree to indemnify and hold Metaieb LLC harmless from any claims arising out of your violation of these Terms or your misuse of the Service.
Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts.
Changes
We may update these Terms from time to time. If we make material changes, we will notify active accounts by email. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
